MINUTES OF MONTHLY
MEETING OF CLONAKILTY TOWN COUNCIL
HELD ON TUESDAY 7th DECEMBER 2010 AT 2.00
PM IN COUNCIL CHAMBER, OLD MILL, KENT ST, CLONAKILTY.

Members Present: Cllr.
Kevin O’Regan (Mayor), Cllr. Cionnáith Ó Súilleabháin, Cllr. Anthony McDermott,
Cllr. Humphrey Deegan, Cllr. John Loughnan, Cllr. Michael O’Regan.
Officers Present: Moira Murrell Town Manager, John Conroy,
Town Engineer, Justin England, Town Clerk, Gerard Harte, Staff Officer.
Apologies: Cllr. Aidan Pendlebury, Cllr. Anne Cullinane,
Cllr. Phil O’Regan
The Mayor announced that there would not be a proposal for a
suspension of standing orders in order to facilitate a presentation on a new
Tenancy Support Service for West Cork as the speaker could not attend due to
bad weather conditions.
1. CONFIRMATION OF MINUTES
a) Minutes of November Monthly Meeting
On the proposal of Cllr. Loughnan and seconded by Mayor Kevin
O’Regan, the minutes of the November monthly meeting were adopted.
2. MATTERS ARISING FROM MINUTES
Cllr. Ó’ Súilleabháin
referred to item Footpath/Hoarding bordering Scally’s Supermarket. The Town Clerk
informed him that the work had commenced in moving the hoarding away from the
public footpath.
Cllr. Ó
Súilleabháin referred to item - Booklet on Signage. The Town Clerk said that it
was hoped to have the booklet in early 2011.
Cllr. McDermott
referred to item – Deasy’s Car Park. He enquired about the opening times of the
new gates. The Town Clerk informed him that they would be opened 8.00am-8.00pm
and that notices would be erected in the car park alerting users to the opening
times.
Cllr. Loughnan
referred to the motion regarding the Mayor meeting with the Student Council
bodies of Clonakilty Community College and Sacred Heart Secondary Schools. He
told Members that from his work with the JPC, there has been goodwill from the
students towards the JPC. Mayor O’Regan informed the Members that he attended
two events at the Secondary Schools recently.
Cllr. Ó’ Súilleabháin
referred to item- Croppy Park. The Town Engineer informed him that the works
there had yet to be completed.

4. STATUTORY BUSINESS OF THE COUNCIL
(a) Budget Meeting
It was
agreed that a pre-estimates meeting would take place on Tuesday 14th
December 2010 at which time a date would be agreed for the annual budget
meeting.
5. REPORTS
AND RECOMMENDATIONS OF COMMITTEES OF THE COUNCIL
a) Meetings of Sub-Committees
Mayor Kevin
O’Regan informed the Members that the last Flooding Sub-Committee and Bye-Laws
Sub-Committee meetings did not take place due to lack of attendance by
committee members. He suggested that future meeting times be changed to 11.00am
to facilitate attendance.
6. REPORTS AND RECOMMENDATIONS OF OFFICERS OF THE COUNCIL
a) Planning Applications
Planning
applications that had been received since the previous meeting were laid before
the meeting.
b) Managers
Orders
The Manager’s Orders
signed since the previous meeting were laid before the meeting.
c) Wastewater Treatment Plant
The Town
Engineer gave an update on the above.
d) Windows and doors
replacement programme.
The Town Clerk
informed Members that it was hoped to start measuring the windows this week
with installation of the windows and doors commencing in January.
e) Application for Community
Funding from Clonakilty Chamber of
Commerce
On the proposal
from Cllr. McDermott and seconded by Cllr. Michael O’Regan, it was agreed to
give €500.00 to the Chamber of Commerce.
As per the
October meeting the remaining community funding budget would be allocated to
the Youth Café.
7.
NOTICES OF MOTION
a) Motion from Cllr. John
M Loughnan
" Following the long overdue and most welcome road improvements to the N71
at Whites Gates on the N71 Clonakilty / Bandon Road, this Council requests
the NRA / Cork County Council to clarify for us what further upgrading of this
road can we expect to be completed in 2011.”
This motion was proposed by Cllr. Loughnan
and seconded by Cllr. O’Súilleabháin.
Following a short discussion by Members, the
Town Engineer gave an outline of works currently underway and those proposed in
2011.

(a) Motion from Naas Town Council
“That this Town Council immediately write to the
Minister for Health and Children, Mary Harney T.D., urging her
to reconsider the site for the proposed National Children's
Hospital .”
The motion was
marked as read.
b) Motion from Carrig on Suir Town Council
“That Carrick
on Suir Town Council would request a review of the powers of HIQA (Health
Information and Quality Authority) in the ability of its inspectorate team to
decide the appropriate/inappropriate care needs of people requiring care in
nursing homes and other residential settings and the fact that there is no
place in current nursing home legislation to the right of redress by care
providers following publication of their findings.”
The
motion was marked as read.
c) Motion from North
Tipperary County Council
The letter was circulated to the Members.
On the proposal
of Cllr. Ó Suilleabháin and seconded by Cllr. Deegan it was agreed not to adopt
this motion.
(d) Motion from Bantry Town Council
“That this Council,
writes to the Minister’s for Transport, Environment, Justice and the Attorney
General and their respective departments, to ask that they introduce
legislation as soon as possible which would oblige car owners to apply in
writing to their local Garda Superintendent for a special exemption if they
wished to make modifications to engines or any other mechanical parts of
vehicles, which varies in any way from the original factory settings or
specifications of the vehicle. The
official form would ask the applicant to outline in detail all changes being
proposed and to clearly state the reason(s) for the proposed change(s) to the
vehicle. Furthermore, before such
decisions would be arrived at, the Garda Superintendent would liaise with the
insurance company of the applicant. If
passed, this motion will be forwarded to other local authorities, our JPC, and
the road Safety Authority.

(e) Motion from Monaghan
Town Council
“That this
Council calls on the Government to address the plight of the
self-employed, who now find
themselves unemployed, to access welfare
assistance most speedily”.
On the proposal of Cllr. O’Suilleabháin
and seconded by Mayor
O’Regan this motion was adopted.
(f) Motion from Monaghan Town
Council
“That this Council calls on the Government to
increase the fuel
allowance”.

10. ANY OTHER BUSINESS
a) St. Vincent de Paul
A letter of
thanks from the Clonakilty Conference of St. Vincent de Paul regarding the
Clonakilty Town Council Community & Sports Awards was circulated to the
Members.
b) Parking
Cllr. Loughnan requested that larger 2 hour
parking limit signs should be erected at the Kent Street Car Park. He said that
the adherence to the time limit should be policed better. The Town Clerk said that he had discussed
this matter with the traffic warden and was satisfied that the Car Park was
been well policed.
c) Manager’s Order No.50/10
Cllr. Deegan
referred to Manager’s Order 50/10 which refers to a Planning Permission at the
Waterfront. He queried whether this change of use was a contravention of the Town
Development Plan. The Town Manager advised that all reports in relation to this
planning were available on the planning file.
d) Joint Policing Committee
Cllr, Deegan informed the Members
that the auditorium at the Dept. of Marine offices could be made available for
the public meeting of the Joint Policing Committee.
e) Bad Weather
Cllr. Ó Suilleabháin suggested
that there should emergency response committee to act during times of adverse
weather conditions. The Town Engineer suggested that the Flood Sub-Committee
could be given an extended brief to deal with this matter.
f) Transportation Plan
Cllr. O’Suilleabháin enquired when the
Transportation Plan was
going out to public consultation.
The Town Clerk informed him that it was hoped to go to public consultation in
late January.
g) Book Launch- Municipal Revolution in Ireland
Cllr. O’Suilleabháin referred to a
recently published book about the history of local municipal authorities in
Ireland.
h) Planning Permissions
Cllr. O’Suilleabháin referred to planning permissions which were
granted subsequent to recently granted planning permissions. The Town Manager informed
the Members that planning control and development was an executive function.
i) 8th December
Mayor Kevin O’Regan requested that
people shop local in the run up to Christmas. He informed the Members that the
Christmas Lights would be turned on at Astna Square at 5.00pm.
